What Is A Felony DUI?

While a simple, first-offense DUI is a misdemeanor, DUI charges can be raised to the level of a felony in the case of:

  • Repeat offense: At the third offense within 10 years, a DUI is automatically a felony in Florida.
  • Bodily harm: If you were involved in a drunk driving accident in which someone was seriously injured, the crime will be considered a felony whether it is a multiple DUI or a first offense.

The penalties for these felonies are much stricter than for a misdemeanor DUI: the maximum penalty is a $5,000 fine and/or five years of imprisonment. The license revocation period also increases, and may be as much as 10 years.
